Your participation in the LeagueStar Fantasy Football game is contingent upon your agreement to the following terms and conditions as well as the Rules (RULES (make this a link to the Rules page)) Your participation in this competition is an express agreement to be bound by and to comply with the following terms and conditions. No employee, officer, manager or director of LeagueStar Pty. is authorised to grant any exception to this agreement and no exception will be granted by LeagueStar. These rules are for your protection and to insure that every participant is provided the same opportunity to enjoy a fair and unbiased competition.

1. All participants must register to participate in the Game by completing the registration process online via the LeagueStar website at www.LeagueStar.com ("the Game Site") All participants, also hereinafter referred to as "Players", must comply with the relevant Game Site rules and the written agreements set forth therein. The online, Game Site registration process is the sole means to register to participate in the game.

2. All participants avow that they are aged 18 years or over, no player under the age of 18 years will be considered as validly registered regardless of his representations and completion of the online Game Site registration process. LeagueStar Pty. shall have no obligation to recognise such invalid registrations and shall make no payments or awards to such illegal participants. Employees (and their immediate families) of LeagueStar Pty., S. Jared Properties Ltd., Premier League Sports Foundation, The Football Association Premier League Limited ("The F.A. Premier League"), and any of their subsidiaries, affiliates and aliases are prohibited from entering and no such entry will be recognized by LeagueStar Pty.

3. All entrants agrees to be bound by these terms and conditions and by the Game Rules as set forth on the site at www.leaguestar.com.

4. All entries must be submitted by the individual participant. LeagueStar Pty. shall have no obligations or responsibility for corrupted, delayed, or incomplete entries nor for any entry not received LeagueStar Pty. for any reason. Any such entries will be deemed as having never been submitted and shall be invalid. The computer record of the application maintained by LeagueStar Pty. will be deemed the formal application. Any application not adhering to the above format, incorrect applications or incomplete applications will be invalid. LeagueStar Pty. is not responsible for applications information or results lost or delayed in the course of transmission. LeagueStar Pty. is the sole authority for arbitration and non-judicial adjudication of disputes regarding all issues pertaining to such entries and its decision shall be final.

5. Any qualified applicant may register as many times as desired so long as all registration rules and requirements are complied with and the information submitted by the applicant is truthful and current as of the date of registration.

6. Any player who is adjudged to have committed or attempted to commit fraud, collusion with any other party to defraud, or manipulation with intent to defraud shall be declared ineligible to participate retroactive to the first date of the participant's registration with LeagueStar Pty. No awards shall be paid to such a participant and LeagueStar reserves the right reclaim any prior awards paid to or otherwise due to such a participant.

6. LeagueStar Pty. shall have the sole and irrevocable right to update, amend, correct, alter, augment, or clarify through written statements the rules and requirements. Such updates, amendments, alterations, corrections, clarifications and augmentations shall be published on the Game Site in a timely fashion by LeagueStar Pty. It shall be the absolute discretion of LeagueStar Pty. to make such modifications. All participants hereby agree that no liability shall attach to LeagueStar Pty. as a result of any such modifications. All participants agree to review the Rules on a timely and regular basis as such Rules are a part of these terms and conditions.

7. LeagueStar Pty. will have the sole right to adjudicate and arbitrate all issues relating to the interpretation of the Rules as well as all other matters relevant to the conduct of the Game. LeagueStar Pty. decisions regarding the awarding of points, and awards to any and all participants shall be conclusive and and authoritative.

8. Entry deadlines published on the online Game Site shall form part of the Rules and all participants agree to abide by such deadlines as well as all other relevant deadlines published on the online Game Site at www.leaguestar.com.

9. The cash awards and all other awards that LeagueStar Pty. may agree to pay the eligible participants shall be published on the online Game Site and shall be awarded according to and in conformance with the participants point standings at the end of the relevant game period. LeagueStar Pty. agrees to pay such awards to all qualifying players within 30 days of the final determination of player rankings. Payment shall be in the form of a credit card credit to the credit card the player charged his entry fee to, a bank cheque, or an electronic transfer of funds into the players' designated bank account. Players shall advise LeagueStar Pty. via the online Game Site's secure payment election form as to the form of payment desired. LeagueStar Pty. shall make all reasonable efforts to accommodate the player's election of the form of payment however in the event that circumstances beyond the control of LeagueStar Pty. pose an unreasonable delay or impediment to such payment form the player shall be so notified by secure email and shall elect an alternative form of payment. For example, if the credit card account the player used to pay his or her entry fee has been cancelled or blocked for any reason and the player has elected to be paid by credit card credit award he or she shall be offered an alternative but equivalent payment form such as an electronic transfer to his nominated bank account or a bank cheque. All award payments are strictly confidential. LeagueStar Pty. shall publish only the player's team name on the online Game Site. No personal or other identifying information shall be published or released to any third party without the player's express consent. The timely payment of all taxes and all other obligations of the players shall be the sole responsibility of the player himself or herself. LeagueStar Pty. shall not with hold payment or make any reduction or adjustment in the player's award for such obligations. Players avow to LeagueStar Pty. that they are aware of their individual responsibilities and shall take full responsibility for their payment, if any such obligations are due.

10. Cash awards shall be paid in the Euro currency. Any charges for conversion into any other currency made by the player's bank or other financial institution shall be for the account of the player. Payments are made in lump sums in single payments in the full amount due the player.

11. All player nominated team names that LeagueStar Pty., in its sole discretion, considers to be offensive, inappropriate, obscene, or misleading shall be rejected and the player promptly advised thereof. In this event, the player shall have up to 5 days to propose an alternative name so rejected may be changed within 7 seven days. Should the alternative name be rejected as well LeagueStar Pty. shall give the player the choice of three acceptable names to select as an alternative. If the player elects to reject all three such offered names he shall be considered ineligible to participate.

12. Players agree to refrain from the posting to the site of any statements or content that is, in the opinion of LeagueStar Pty., offensive, defamatory, libelous, or which might reasonably be adjudged to bring the game, Any and all material posted to any message boards or otherwise published in any form or medium including but not limited to on any website of any nature relating to or in connection with the Game, The F.A. Premier League or any member club of The F.A. Premier League or the game of football into disrepute. Such postings shall constitute a breach of these terms and conditions by any person posting or displaying or otherwise publishing the same.

13. Any breach by any Player of the online Game site Rules from time to time shall be a breach of these terms and conditions.

14. In the event of any breach by any applicant and/or any Player of these terms and conditions The F.A. Premier League reserves the right to refuse entry to the relevant applicant and/or disqualify the player in question from any further participation in the Game and such decision by LeagueStar Pty. shall be final. Any applicant so refused and/or Player so disqualified shall not be eligible to participate in the Game under any other identity or team name.

15. All players who are eligible for a cash award based upon his or her team's performance will be advised of the amount of his or her winnings within a reasonable but prompt time via secure email or via a password protected player's page on the online Game Site. Players must advise LeagueStar Pty. of their current contact details and desired method of payment in a reasonable but prompt time period so that the awards may be paid without undue delay.

16. The winning Teams’ names will be published on the Site by the last day of the month following the month in respect of which the Monthly Prize is awarded in respect of winners of Monthly Prizes and by Thursday 30th June 2005 in respect of the winner of the Season Winners.

17. LeagueStar Pty. shall not be liable for any loss or damage whatsoever which is suffered by any person (including but not limited to indirect or consequential loss) as a result of or in connection with or arising out of his participation in the game or any award made by LeagueStar Pty. to the player or any player.

18. LeagueStar Pty. accepts no responsibility nor liability, direct or consequential for any damage, loss, injury or disappointment suffered by any entrant entering the Game or for any site outages, delays, inaccessibility or technical failures or malfunction of any data or telecommunications network or lines, computer on-line systems, servers, or Internet access providers, computer equipment, software failure of any electronic communication, email, fax or entry to be received as a direct or indirect result of technical problems on the Internet, communications facilities, Internet site, or any server, including, but not limited to, any damage to a Participant's or a third party’s computer or data related to or resulting from participation in the Game.

19. The applications, programming and HTML documents and content, otherwise known as software, and all written material pertaining to the Game are the copyright material and property of LeagueStar Pty. and may not be copied, reproduced, plagiarized nor used for recreational or commercial purposes in any way without the express written prior permission of the chairman of LeagueStar Pty.

20. Players' names and addresses and their awards may not be used for future promotional, marketing and publicity purposes without their written, signed and notarised agreement. Player names and email addresses are confidential and will not be sold, leased, rented, or disclosed without their consent.

21. These terms and conditions shall be governed by and construed in accordance with the laws of England and Wales and the parties agree to submit to the exclusive jurisdiction of the Courts of England and Wales.
